In compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “Law”), this Privacy Notice is issued.

Privacy notice for customers and prospective customers.

I. Personal Data

SARAGO Grupo Empresarial, S.C., with offices located at Av. del Tule No. 830, Piso 1, Oficinas 3 y 4, Col. Puertas del Tule, Zapopan, Jalisco, Mexico, hereby informs you that the personal data you provide to us as a customer or prospective customer will be processed strictly for the purposes set forth below. The personal data to be processed by SARAGO and its group of companies consists of the data subject’s personal information, which may include: full name, date and place of birth, age, gender, nationality, marital status, address, telephone number, email address, official identification, CURP (Unique Population Registry Code), RFC (Federal Taxpayer Registry), billing information, payment information, and data derived from your digital interaction with our communication channels. When you take part in meetings, sessions, hearings, or in-person or virtual interactions, your image and voice may also be collected and, where applicable, audio and/or video recordings, among other data strictly necessary for the purposes set forth below.

Sensitive data: Where necessary due to the nature of the matter, sensitive data contained in the documentation of the dispute or in the data subject’s statements may be processed, such as health data, racial or ethnic origin, religious, philosophical, or moral beliefs, union membership, political opinions, or sexual preference. Financial or asset-related data may also be collected, such as banking, tax, and billing information and proof of payment. In the case of minors, the data of the father, mother, or legal guardian will also be collected. In the case of foreign nationals, a passport, visa, immigration form, or other documents evidencing identity, nationality, and legal stay in the country may also be requested.

If we do not have your personal data, we would not be able to properly provide you with the goods and/or services you require from us, inform you of changes to them, or meet your needs appropriately; therefore, SARAGO and its group of companies would bear no liability arising therefrom.

II. Purposes of the Processing of Personal Data

SARAGO and its group of companies will collect your personal data with no intention of disclosing it, and it will be used to comply with the obligations arising from the legal relationship established with each data subject, as well as to address applicable legal and administrative requirements. Additionally, such data may be used for secondary purposes aimed at improving the experience of customers and other persons associated with SARAGO and its group of companies, for the following purposes:

Additionally, provided the data subject does not express an objection, your personal data may be processed for marketing, advertising, and commercial prospecting purposes, including sending information about our services, promotions, newsletters, events, invitations, satisfaction surveys, informational content, institutional updates, and activities related to alternative dispute resolution mechanisms.

An objection to the processing of personal data for secondary purposes may be expressed through the contact channels made available by SARAGO and its group of companies, without this affecting the primary purposes necessary for the corresponding legal relationship.

Personal data will be kept strictly confidential and will not be used for any purpose other than those stated above, unless this Privacy Notice is amended.

III. Collection of Personal Data

For the collection of personal data, we follow all the principles set forth in the Law, such as lawfulness, quality, consent, information, purpose, loyalty, proportionality, and accountability.

Personal data will be collected directly or indirectly, in person or through various means such as websites, social media, digital platforms, email, telephone, or through transfers made to us by third parties.

In addition, we may obtain information about the data subject from other sources permitted by law, such as telephone directories, references from companies or individuals, and public databases of any public or private entity or agency, among others.

IV. Options and Means to Limit the Use or Disclosure of Data

SARAGO and its group of companies has the administrative, technical, and physical security measures necessary and sufficient to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access, or processing.

You may exercise your ARCO rights (access, rectification, cancellation, and/or objection) by email at contacto@gruposarago.com or by telephone at +52 33 2902 2174. The ARCO request must contain and be accompanied by the elements set forth in Article 28 of the Law, such as:

SARAGO and its group of companies will not be required to cancel personal data in any of the cases established in the Law, including the following: when it relates to the parties to a private, corporate, or administrative agreement and is necessary for its performance and fulfillment; when it must be processed by legal provision; when doing so would hinder judicial or administrative proceedings related to tax obligations, the investigation and prosecution of crimes, or the updating of administrative sanctions; when it is necessary to protect the legally protected interests of the data subject; when it is necessary to carry out an action in the public interest; or when it is necessary to fulfill an obligation legally undertaken by the data subject.

V. Data Transfers

Personal data will never be disclosed or shared with third parties; the affiliated companies of SARAGO, which will need the personal data for the purposes stated above, are not considered third parties.

The foregoing shall not prevent the data from being shared with suppliers or service providers, related companies, or competent authorities, solely when necessary to comply with legal, contractual, tax, or administrative obligations, or to acknowledge, exercise, or defend rights in judicial proceedings.

VI. Consent of the Data Subject

Pursuant to Article 7 of the Law, the data subject will be deemed to have tacitly consented to the processing of their data when, this Privacy Notice having been made available to them, they do not express an objection.

VII. Changes to this Privacy Notice

We reserve the right to change this Privacy Notice at any time. Any changes will be made available through any of the following means: (i) visible notices at our facilities; (ii) on our website.
